The following terms and conditions apply to all transactions, purchase agreements, and bespoke manufacturing orders processed by PouffeLOVE.ie. These conditions do not affect your statutory legal rights under Irish and EU consumer law.

1. Terminology

The following terminology applies to these Terms and Conditions, Privacy Statement, and Disclaimer Notice and any or all Agreements: “Client”, “You”, and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, and “Us” refers to PouffeLOVE. “Party”, “Parties”, or “Us” refers to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

2. Privacy Statement

We are committed to protecting your privacy. Authorized employees within the company on a need-to-know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. We will investigate any unauthorized actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

3. Confidentiality & Data Protection

All personal information is protected by local, Irish, and European GDPR data protection laws. By accessing our services and placing orders via PouffeLOVE.ie, you consent to the collection, storage, and processing of your personal information where necessary for transaction fulfillment, logistics routing, and customer support. Clients have the right to request copies of their records on reasonable notice. We will not sell, share, or rent your personal information to any third party or use your email address for unsolicited mail. Any emails sent by PouffeLOVE will strictly relate to the provision of agreed services and products.

4. Disclaimer, Exclusions and Limitations

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, PouffeLOVE excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature.

PouffeLOVE excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits, damage caused to your computer, software, systems, and programs, and the data thereon or any other direct or indirect, consequential, and incidental damages. None of your statutory rights as a consumer are affected.

5. Payment

Major Credit/Debit Cards, Stripe, and Direct Bank Transfers are all acceptable methods of payment. Our terms of payment are full payment upon placement of the order prior to dispatch or artisan workshop manufacturing allocation. Goods remain the property of PouffeLOVE until paid for in full.

6. Shipping, Warranty, and Return Policy

A. Warranty

Our warranty does not extend to products damaged as a result of improper installation, misuse, or unauthorized assembly alterations. The warranty does not cover accidental structural damage, damages from hot liquids or chemicals, or damages due to improper maintenance. Defective products must be notified immediately in writing accompanied by high-resolution photographic evidence.

B. Standard Catalog Inventory Stock Items (Return Policy)

Eligible, non-customized standard catalog inventory stock items may be returned within 14 days of delivery. All items must arrive completely unused, unaltered, and securely repacked in original protective factory packaging. Buyers are responsible for arranging and paying for return pallet/freight logistics (estimated between €80 and €250+ depending on carrier and location). Refunds are processed minus original freight logistics allocations once received and inspected.

C. Statutory Exclusion: Made-to-Order & Custom Tailored Goods

Under Part 5 of the Irish Consumer Rights Act 2022 and Article 16(c) of EU Directive 2011/83/EU, the statutory 14-day right of withdrawal / cooling-off cancellation does not apply to goods that are made to the consumer’s specifications or are clearly personalised. This statutory exclusion applies to all extendable dining tables (individually cut, surfaced with chosen wood veneers or laminates, and custom-finished), customized benches, ottomans, chairs, and bespoke furniture units. No returns, cancellations, or refunds are accepted for made-to-order items once production scheduling has commenced.

D. Flat-Pack Assembly Boundary & Diminished Value

Under Section 107 of the Consumer Rights Act 2022, consumer examination rights are limited strictly to what is permissible in a physical store showroom. Once protective packaging is breached, hardware packets unsealed, screws driven, or structural frame pieces assembled, the furniture item is legally classified as used and diminished in value. Assembled furniture cannot be accepted for return or refund under any circumstances.

7. Cancellation Policy

For standard inventory stock items, notice of cancellation must be submitted in writing prior to dispatch. For bespoke, customized, or made-to-order furniture items, production commitments and material sourcing (such as veneer ordering, board pressing, and timber cutting) occur immediately upon order placement. Therefore, custom orders cannot be canceled, amended, or refunded once workshop preparation has begun.

8. Availability & Production Windows

Unless otherwise stated, products featured on this website are available for delivery within Ireland and the UK. Production windows for custom artisan orders typically range from 2 to 4 weeks, occasionally extending up to 5 to 6 weeks during high-volume periods or complex custom requests. We reserve the right to safely adjust timelines when necessary to ensure structural manufacturing integrity.

9. Log Files & Cookies

We use IP addresses to analyze trends, administer the site, track user movement, and gather broad demographic information for aggregate use. Like most interactive websites, PouffeLOVE.ie uses cookies to enable us to retrieve user details for each visit, remember basket contents, and enhance site functionality.

10. Intellectual Property & Communication

Copyright and other relevant intellectual property rights exist on all text, design configurators, photographic imagery, and content relating to PouffeLOVE’s services. Official customer correspondence should be directed to our registered support email: info@pouffelove.ie or helpline 086-792-1662.

11. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, political insurgence, riot, civil unrest, act of civil or military authority, strike, cross-border freight disruptions, or severe weather conditions.

12. Governing Law & Jurisdiction

The laws of Ireland govern these terms and conditions. By accessing this website and purchasing products from PouffeLOVE, you consent to these terms and conditions and to the exclusive jurisdiction of the Irish courts in all disputes arising out of such access or transactions.

PouffeLOVE reserves the right to change these conditions from time to time as it sees fit. Continued use of the site signifies acceptance of any adjustment to these terms.
